The final day of orca season leaves an open question: how should tourism coexist with one of the ocean's most intelligent predators?

With the official close of the 2026 orca-watching season in Baja California Sur, one of the most intense debates in Mexico's nature tourism also comes to an end, at least for this year.

Over recent weeks, Mares de México has received dozens of messages from researchers, tour operators, visitors, photographers, and residents of various coastal communities. Some celebrate that a regulatory framework finally exists for an activity that operated for years without specific rules; others believe the new provisions pose a risk to one of the most intelligent and socially complex species on the planet.
It is important to clarify that this text does not represent the institutional position of Mares de México. It does not seek to defend or discredit the new management plan. It is simply a journalistic analysis that brings together some of the main arguments expressed by the different sectors involved in this discussion and summarizes the debate that has marked the first season under this new regulatory scheme.
There is one point on which practically everyone agrees: observation tourism can become an extraordinary conservation tool. In many regions of the world it has allowed coastal communities to find in nature a source of income more valuable than its exploitation, strengthening environmental education, scientific research, and the protection of emblematic species.
However, the very success of tourism has also raised new questions. When an activity grows rapidly, the challenge is no longer solely to attract visitors, but to keep that growth within limits that nature can withstand. What begins as an exceptional experience can, over time, transform into a mass activity whose pressure becomes increasingly difficult to control.
For years, swimming with orcas in Mexico existed within an unclear legal situation. Some operators argued that the activity was not expressly prohibited, while others pointed out that various instruments issued by environmental authorities restricted interaction with cetaceans. That lack of clarity gave rise to a market that operated in a gray area for several years.
The new management plan changed that scenario. Rather than prohibiting an activity that was already occurring or authorizing an entirely new one, it established a regulatory framework for a practice that already existed. Yet it was precisely there that a new discussion arose: are these rules enough to protect a species like the orca?
One of the most repeated arguments among those who question the plan is that part of its structure took the tourism management of the whale shark as a reference. Although both allow close encounters with visitors, they belong to completely different biological groups.
The whale shark is a cartilaginous fish; the orca is a cetacean with complex social organization, advanced cognitive abilities, and cultural behaviors passed down between generations. For some specialists, that difference justifies asking whether the two species should be managed under completely distinct approaches. Others believe that general regulatory principles can be adapted, as long as the specific measures respond adequately to the biology and behavior of each species.
It is also important to recognize that the plan was not built unilaterally. Local communities, tour operators, researchers, and authorities participated in meetings and working groups where modifications were discussed before its implementation. For some, this process made it possible to incorporate the experience of those who have worked at sea for years. For others, the final regulations still do not reflect the level of precaution that should apply when dealing with cetaceans.
Perhaps one of the strongest arguments presented by those who support the new management scheme has to do with the historical behavior of orcas toward people. To date, there is no confirmed fatal attack by a wild orca on a human being. The serious incidents on record have occurred with animals kept in captivity, a context very different from what these animals experience in the ocean and one that many researchers have associated with conditions capable of generating high levels of stress.

From that perspective, some consider that the risk to people is extremely low and that, under adequate regulations, tourist interaction can develop responsibly.
Another of the most recurring arguments among those who hold a more permissive position is the role that images play in conservation. They argue that photos and videos shared on social media allow thousands or even millions of people to encounter orcas in the wild, generating admiration, empathy, and a greater willingness to protect them. From this perspective, it is difficult to conserve what people have never seen or with which they have not managed to establish an emotional connection.
With the management plan coming into force and the formal regulation of the activity, the presence of content related to swimming with and observing orcas has increased considerably. Promotional posts, marketing campaigns, collaborations with content creators, and tour operator ads have multiplied, inviting more and more people to encounter orcas in the wild.
Those who support this trend believe that greater exposure can strengthen nature tourism, generate economic benefits for local communities, increase interest in research, and expand the number of people committed to marine conservation.
By contrast, the more conservative sectors warn that this same promotion could accelerate the growth of the activity at a rate beyond the ecosystem's management capacity. Their concern is not focused solely on the number of vessels present today, but on the speed at which demand could increase over the coming years, driven by social media and tourism promotion campaigns.
But those who hold a more conservative position raise a different question.
The discussion should not center solely on whether orcas pose a danger to people, but on how much people can affect orcas.
One of the aspects that has most fueled the debate this season is precisely the gap between what the management plan establishes and what some people have documented in the water.
The current plan permits the presence of up to 24 vessels around a single orca or group of orcas under certain conditions. However, some of the videos and images circulated this season show concentrations of up to 35 vessels around groups of between seven and nine orcas. These scenes have raised concern among part of the conservation community, which believes that the accelerated growth of the activity could translate into ever-increasing pressure on the animals.
Added to this are videos showing people trying to touch orcas, swimming to intercept their path, or positioning themselves directly in front of their direction of travel. Regardless of whether these cases represent specific breaches of the management plan or particular situations whose enforcement falls to the competent authorities to assess, the images have intensified the debate over the need to strengthen oversight, improve participant education, and evaluate whether current regulations are sufficient to prevent conduct that could alter the natural behavior of these cetaceans.
For those who hold a more conservative position, these scenes represent a warning sign. They argue that if this type of situation occurs during the first months of the plan's implementation, the challenge could grow as the activity continues expanding and attracts a greater number of vessels and visitors in the seasons to come.
Those who support the new scheme respond that this is precisely why a management plan exists: to bring order to an activity that previously took place without specific rules and to give authorities the tools to supervise it and correct conduct that does not comply with the regulation. From this perspective, the existence of incidents does not necessarily prove that the plan is flawed, but rather that its success will depend on its correct implementation, oversight, and capacity to adapt.
At present, science is still working to answer with greater precision what effects repeated exposure to tourism may have on a species with complex social organization, high cognitive capacity, and cultural behaviors passed down between generations. Although there are studies on disturbance caused by vessels and tourism in various cetaceans, there are still open questions about the level of pressure that a growing activity can specifically generate on the orca populations that visit Mexico.
Perhaps that is the greatest conclusion this season leaves behind.
Beyond their differences, practically all the actors involved say they pursue the same goal: to conserve orcas.
The difference appears when the moment comes to decide the best path to achieve it.
While some believe that well-regulated tourism can strengthen conservation through education, research, and income for local communities, others maintain that certain species should remain completely free of any direct interaction with people, even under regulated schemes.
Neither of those positions can, on its own, answer today all the questions raised by such a complex issue.
Perhaps the discussion no longer revolves solely around whether orcas are dangerous to human beings. The question now beginning to gain force is the opposite: what is the cumulative effect that an ever-greater human presence may have on orcas? Can a highly social species modify its behavior due to the constant pressure of vessels, swimmers, and growing tourist demand? Is there an acceptable level of disturbance, or do we simply not yet have enough scientific information to answer?
The real challenge is only just beginning.
The success of the new plan will depend not only on having established rules, but on the capacity to enforce them at sea, monitor their results, generate independent scientific evidence, and change whatever proves necessary as knowledge evolves.
Conservation rarely consists of making a decision forever. It consists of observing, learning, correcting, and evaluating again.
The 2026 season has ended.
The debate over how to responsibly coexist with one of the planet's most extraordinary predators is only just beginning.
